Labor inventions and their dynamics for university professors in Cuba

Abstract

Introduction: Business updating and competitiveness have not been alien to the Cuban context, where labor law institutions are being perfected, namely: the legal protection of labor inventions; generating transformations in the Cuban legal structural order in the order of their legal protection within the formalization of the Labor Legal Relationship following the Labor Code "Law No. 116 of 2014." Multiple questions remain on the part of inventors and employers, the latter lacking business culture on the subject, especially for Cuban universities, institutions generating science and technology where professors transversalize their work performance from the role of researchers and their professionalizing capacities. Materials and methods: Data and information were triangulated in order to achieve a better interpretation of them and achieve the pertinent verification. Content analysis constitutes the technique that facilitates the documentary analysis of those that express, through their information value, the significant data that allow collecting information about the current situation. Results: The promotion and increase of labor inventions can undoubtedly increase the generation of intangible assets and represent the contribution of the knowledge economy to the country's development, boosting business competitiveness; intellectual property is a tool for sociocultural and economic growth. Discussion: Due to these particularities, inventors or authors must be aware of the patentability requirements and the registration procedure to comply with their inalienable rights to registration and exclusive powers. Conclusions: In Cuba, there is no specific legislation on labor inventions; it is regulated only briefly in Decree Law No. 290 of 2012. The Labor Code, Law No. 116 of 2014, does not regulate this matter. Rather, it is inferred from the rights and duties of workers at the time of formalizing employment relationships and compliance with trade secrets.
