Preventive detention and the dismissal of immediate proceedings: a systematic review of the regulatory gap in Peru

Introduction: The inadmissibility of initiating expedited proceedings when a pending request for pretrial detention exists reveals a regulatory gap in the Peruvian criminal justice system, which may generate legal uncertainty and undermine procedural legality and effective judicial protection. Objective: To analyze the available scientific evidence on pretrial detention and identify the existence of a regulatory gap concerning the inadmissibility of expedited proceedings in Peru. Materials and Methods: A systematic literature review was conducted in accordance with the PRISMA 2020 guidelines. Searches were performed in Scopus, Web of Science, SciELO, Dialnet, and Google Scholar, considering publications from 2020 to 2026. Following the identification, deduplication, screening, and eligibility stages, 22 studies were included in the qualitative synthesis. Results: Of the studies reviewed, 22.7% addressed the legal nature of pretrial detention; 22.7% focused on the presumption of innocence and personal liberty; 18.2% examined effective judicial protection and due process; 22.7% addressed proportionality and legality review; and 13.7% focused on the inadmissibility of expedited proceedings. Furthermore, 14 studies (63.6%) were published between 2024 and 2026. Discussion: A consensus was identified regarding the exceptional and instrumental nature of pretrial detention; however, scientific literature addressing the legal effects of the inadmissibility of expedited proceedings remains limited. Conclusions: The evidence reveals a regulatory insufficiency that may generate legal uncertainty and affect procedural legality, thereby supporting the need for legislative reform establishing clear criteria for resolving this procedural situation.
